- Eligibility
No purchase is necessary to
enter the VTech Online Telephone Giveaway Contest (the "Contest").
In accordance with these terms and conditions (the "Terms and Conditions"), this Contest is open to all individuals, 18 years of age or older as of the date of
entry, who legally reside in the United States and has a verifiable email and valid mailing address. All employees and consultants of VTech
Communications, Inc. ("VTech") or its affiliates, subsidiaries, members of their immediate families, or those with whom they are domiciled,
are not eligible. In addition, anyone living in a state where the Contest is prohibited, taxed, or otherwise restricted under state and local
laws, rules, or regulations is ineligible. VTech expressly disclaims any responsibility or liability for any entrant who enters when it is
illegal for them to do so. By entering this Contest, entrants agree to waive any additional rights granted in regard to contests by the state
in which they are domiciled.
- How to Enter
An entry will automatically be generated and submitted upon the completion of this
Web Form
and entry of a valid email address which reflects acceptance of these Terms and Conditions.
All entries must be submitted online. Mail entries are not eligible. VTech assumes no responsibility for lost, late, or misdirected entries. Proof
of transmission of an entry will not constitute proof of receipt of said entry. Limit one entry per household.
- Winning
All timely entries within the given month
will be collected after the Contest is open, and the winning entry will be randomly drawn by a designated VTech employee. Within three (3) business
days of the drawing, the winner will be notified that he/she has been chosen to win the prize, by e-mail, based upon the information provided in
the entry form. If the winner does not claim the prize within fourteen (14) days following the first notification attempt, such person may be
disqualified and an alternate selected in accordance with these rules. If you are chosen as the winner, VTech will coordinate shipping arrangements
with you. We will ship to one destination only within the United States.
- Prize
The winner will receive, as a prize,
the VTech LS6225-3 cordless telephone system.
VTech reserves the right to exchange this prize for a comparable cordless telephone. The winner may be required to sign an affidavit of eligibility and release
of liability prior to being declared the winner. The winner may be required to provide some form of identification before receiving any prize.
The prize must be claimed by the winner and is not transferable.
- Legal Considerations
The odds of winning are estimated at 1 in
1000
entries, but depend upon the number of timely entries received. Upon shipment to the winner's address, VTech will be deemed to have awarded the prize to the winner with
the winner assuming full responsibility for the prize. There will be no substitutions for the prize. Except for shipping costs which will be paid by
VTech, the winner, and not VTech, is solely responsible for all other arrangements, costs and expenses associated with receiving the prize, including
without limitation, any taxes or other fees imposed by a government authority. All entrants agree that submitting the entry form constitutes agreement
to the terms and conditions of these Rules. The winner shall be required to sign an additional liability waiver and statement of eligibility before
receiving any prize. By submitting an entry form, the entrant is representing and warranting to VTech that he/she is an eligible contestant.
- Indemnification and Disclaimer
Each entrant agrees to indemnify, defend and hold harmless VTech and its affiliates, subsidiaries, officers,
directors, representatives, agents, and employees from any and all liability whatsoever for any injuries, losses, or damages of any kind arising from or in
connection with, either directly or indirectly: (1) the entrant's breach of any representation or warranty contained herein, (2) awarding, acceptance,
receipt, possession, use, and/or misuse of any prize awarded herein; or (3) participation in the Contest. VTech is not responsible for incorrect or
inaccurate entry of information including, but not limited to, technical malfunctions, human error, lost/delayed data transmission, omission, interruption,
deletion, defect, line failures of any telephone network, computer equipment, software or any combination thereof, entry materials that have been tampered
with, or entries that are illegible, late, lost, damaged, postage due, or misdirected.
- Amendments; Termination
VTech reserves the right to cancel, terminate, modify, or suspend this Contest for any reason, including but not
limited to, fraud, technical failures, or any other causes beyond the control of VTech that corrupts or affects the administration, security, fairness,
integrity, or proper conduct of this Contest.
- Governing Law
This Contest shall be interpreted and governed by the laws of the State of Oregon and any applicable laws and regulations
of the United States. The entrant agrees that any and all disputes which cannot be resolved between the parties, and causes of action arising out of or
connected with this Contest, shall be resolved individually, without resort to any form of class action, exclusively, before a state or federal court located
in Washington County, Oregon having competent jurisdiction, which Court shall apply the laws of the State of Oregon without regard to any principles of conflicts
of laws, and submission of said entry constitutes acceptance of such laws. The entrant further agrees that no claims, judgments or awards shall exceed the amount
of the Contest prize and under no circumstances shall include attorney's fees; nor shall any entrant be permitted to obtain awards for punitive, incidental,
consequential, or other similar damages or have any damage awards multiplied or increased for any reason.
